Scrivener’s Error
A typographical error or writing error. A “scrivener” or “scribe” is the person writing or typing the document. If the error is a missed word or missed line of type, the document may be corrected with an Affidavit of Scrivener’s Error, signed by the person or a representative of the company which drew up the document.

 

Second Mortgage
A second loan on real estate that a l ready has a mortgage. It is subordinate to the first mortgage. Usually of shorter term and often at a higher interest rate.

 

Section or Section of Land
A parcel of land comprising one square mile or 640 acres.

 

Set Back Lines
Those lines which delineate the required distances for the location of structures in relation to the perimeter of the property.

 

Severalty Ownership
Owned by one person alone. Sole ownership.

 

Special Assessment
Legal charge against real property levied by a public authority to pay the cost of public improvements such as street lights, street improvements, sidewalks, etc.

 

Special Warranty Deed
A deed in which the grantor warrants or guarantees the title only against defects arising during his ownership of the property and not against defects existing before the time of his ownership. A deed wherein the grantor warrants that he is conveying the title to the property “as good as he got it.”

 

Sub-surface Right
The right of ownership to things lying beneath the physical surface of the property.

 

Survey
The process of measuring land to determine its size, location and physical description and the resulting drawing or map.
